If Ms Truss wins the keys to number 10 she will pick up where Boris Johnson left off in unilaterally changing parts of the protocol, a move met with criticism by the US. Mr Biden opposed Brexit during the negotiation and now holds a strong stance on protecting the protocol.
The EU has also warned that any unilateral action would be illegal and face retaliation from the bloc. Senior diplomats also warned that any activation of Article 16 would be seen as “a provocative act” and raise tensions further.
The UK’s next Prime Minister will be announced later today, with the Foreign Secretary the clear front-runner.
